The following definitions apply to the Terms & Conditions of the European Pricing Platform:
Where:
| a. | European Pricing Platform (also hereafter ‘EPP’): the organization offering and providing products and services to Participants and Non-Participants. |
| b. | Participant: party paying a yearly participation fee to participate in the events organized by the EPP and to get access to the online portal site resources and content. |
| c. | Non-Participant: the party commissioning the engagement to participate in one or more selected events organized by the EPP. |
These terms and conditions apply to all products and services provided by the EPP. All mentioned tariffs for the EPP services are excluding VAT.
1) EPP Participation Plans
1.1 The EPP offers Participation Plans for individual persons and organizations underwriting the goals of the EPP: the ‘Individual’, ‘Academic’ , ‘Corporate 3’ , ‘Corporate 6’ and 'Corporate 9' Participation Plan.
1.2 To become a Participant, registration is required by filling in the online registration form on www.pricingplatform.eu. After the EPP receives the online application form the Contract is deemed to have been concluded under these Terms & Conditions.
1.3 Participants pay an annual fee for their Participation Plan. A Participation Plan lasts for the term of 12 months, starting the month/per date the online application is received by the EPP. The Participation Plan is automatically renewed unless the contract is terminated according to the conditions mentioned below.
1.4 By becoming a participant the following access of participation is granted:
· To two free/or with a special participant discount of minimum 10% chapter workshops, to be used within 12 months.
· To the participant-only online section of the EPP portal site, more specifically of the:
- Participant profile details;
- Online resources (articles, whitepapers, research and survey publications);
- Free downloads of past forum presentations;
- Chapter discussion forums;
- Special interest group forums.
· To participate in all EPP workshops, trainings, forums and events with a special participant discount of (minimum) 10%.
1.5 Payment terms:
| - | An invoice for the annual fee will be sent after the online application form is received by the EPP or the Participation Plan is automatically renewed after one year. |
| - | Full payment is required within 14 days after the invoice date. All invoices unless otherwise stated carry a 5% late payment surcharge. The online account of the Participant will be activated after full payment is received. |
| - | The EPP reserves the right to refuse admission to workshops and other events if payment is not received on time. |
1.6 Cancellation:
| - | Cancellation of a Participation Plan must be received in writing two months before the end of the Contract term. Otherwise the Participation Plan will be automatically renewed for the next 12 months. |
| - | Participants have the right to transfer their Participation Plan to a colleague from the same company. Requests for transfer of a Participation Plan have to be received in writing, the same cancellation regulations are applied for transfer to a colleague. |
| - | The EPP reserves the right to cancel a Participation Plan if a Participant did not act accordingly to the EPP’s code of conduct. Upon cancellation the annual fee for the contract term of the participation has to be fully paid (when payment has not been received yet) and is nonrefundable. |
2) EPP Chapter Workshops
2.1 All EPP workshops will be announced on www.pricingplatform.eu.
2.2 Before attending an EPP workshop registration is required by filling in the online registration form on www.pricingplatform.eu. After the EPP receives the online application the Contract is deemed to have been concluded under these Terms & Conditions.
2.3 Participants with an ‘Individual’, ‘Academic’ or ‘Corporate 3, 6 or 9’ participation plan are entitled to participate in two EPP chapter workshops/events for free/or at discount rate of minimum 10%. Subscription fees per workshop are mentioned on the portal site.
2.4 Substitution of the registered participant:
- For EPP participants: substitution (without surcharge) is only allowed by another EPP participant within the same company;
- For non-participants: upon registration substitution is not allowed.
2.5 Cancellation:
| - | All registrations carry a 50% cancellation policy immediately after the online registration form is completed. The workshop fee will not be refunded, but can be credited to a future workshop. |
| - | Cancellations must be received in writing 14 days before the workshop is held. Thereafter, the full workshop fee has to be paid and is nonrefundable. Non-payment or non-attendance does not constitute cancellation. |
| - | By registration to an EPP workshop the attendee agrees that in case of dispute or cancellation of the agreement the EPP will not be able to mitigate its losses for any less than 50% of the total workshop fee. |
| - | If, for any reason, the EPP decides to cancel or postpone a chapter event/workshop, the EPP is not responsible for covering airfare, hotel, or other travel costs incurred by attendees. |
2.6 Payment terms:
Following the online workshop registration, if applicable, full payment is required within 14 days after the invoice date. All invoices unless otherwise stated carry a 5% late payment surcharge. Payment must be received prior to the workshop date. The EPP reserves the right to refuse admission if payment is not received on time.
2.7 While every reasonable effort will be made to adhere to the advertised workshop package, the EPP reserves the right to change event dates, sites or location or omit event features, or merge the event with another event, as it deems necessary without penalty and in such situations no refunds, part refunds or alternative offers shall be made. In case the EPP permanently cancels the event for any reason whatsoever, (including, but not limited to any force majeure occurrence) and provided that the event is not postponed to a later date nor is merged with another event, the attendee shall receive a credit note for the amount that the attendee has paid to such permanently cancelled event, valid for up to one year to be used at another EPP event. No refunds, part refunds or alternative offers shall be made.
2.8 With the workshop registration the Participant / Non-Participant automatically accepts the guidelines as stated in the EPP’s code of conduct, and will act accordingly.
3) EPP Training Programs
3.2 Before attending an EPP training program registration is required by filling in the online registration form on www.pricingplatform.eu. After the EPP receives the online application the Contract is deemed to have been concluded under these Terms & Conditions.
3.3 The fee per training program is mentioned in the program details. Fees are inclusive of program materials and refreshments, unless otherwise stated in the program details.
3.4 Payment terms: following the online training program registration an invoice will be sent. Full payment is required within 14 days after the invoice date. All invoices unless otherwise stated carry a 5% late payment surcharge. Payment must be received prior to the training date. The EPP reserves the right to refuse admission if payment is not received on time.
3.5 Substitution: provided the total training program fee has been paid, substitutions at no extra charge up to 10 working days before the event are allowed. Substitutions between 10 working days and the date of the event will be allowed subject to an administration fee of € 25.00.
3.6 Cancellation:
| - | >If cancellation is made more than 40 working days before the program start date, 90% of the fee will be refunded. |
| - | 50% of the program fee will be refunded for cancellations made between 20-40 days prior to the program start date. |
| - | No refunds will be made for cancellations made later than 20 working days before the program start day. |
| - | Cancellations must always be made in writing. |
| - | If, for any reason, the EPP decides to cancel or postpone the program, the EPP is not responsible for covering airfare, hotel, or other travel costs incurred by attendees. |

4) EPP Job Service
4.1 Participants and Non-Participants have access to the online Job Service. Participants and Non-Participant can search the job database for free.
4.2 Employers have the possibility to advert their job vacancies. Online posting of the vacancy is required. A new job advert will stay online for 60 days and is free of charge. Notice that the EPP is always allowed to refuse visibility on the portal site of any job post.
5) Actions on trainings - workshops - forums
5.1 When you receive an offer, this is not cumulative on a previous offer.
6) Sole cooperation/collaboration, unique projects and services
6.1 In no event, EPP will pay on invoices submitted more than 180 days after an expense has been incurred.
7) EPP Partnerships: Commencement, duration and ending
7.1 Partnership relations can change in the course of time concerning the content/common agreements. The partnership documents are meant to indicate agreements at the start of a partnership. These agreements and the partnership are evaluated periodically by both parties and are silently extended for a period of 12 months.
Ending of the partnership is possible each time up to 3 months for the end of the registration year, by simple writing a letter by one of the involved parties to the EPP. When ending the contract, none of the involved parties are obligated to pay whatever damages that have arisen to each other.
7.2 In no event, EPP will pay on invoices submitted more than 180 days after an expense has been incurred.
8) Applicable Law & Jurisdiction
All Contracts between Clients and the EPP are governed by the laws of Belgium. Unless the parties expressively agree otherwise in writing, all disputes between the Client and the EPP will be referred to the competent District Court of Kortrijk (B).
